The answer is unknown at this time, but in 1972 Margaret
Stuckey, an Arkansas school teacher, was detained, accused of shoplifting
and arrested by an off-duty policeman working security for Dillard
Department Stores Company in Little Rock, Arkansas. No stolen merchandise
was found on Ms. Stuckey, and shortly after receiving an acquittal
in municipal court, she brought a civil suit. A jury awarded her
damages and the Arkansas Supreme Court affirmed the jury verdict
in 1974. Dillard Department Stores, Inc. V. Stuckey, 511 S.W.2d
154 (Ark. S. Ct. 1974). The allegations in Ms. Stuckeys
lawsuit are similar to allegations made in lawsuits filed today
almost 30 years after Ms. Stuckeys horrible experience!
